A transformation demarcation, scheduled for yesterday morning on a plot of land in Tsarahasina Ambohimangakely, was cancelled at the last minute. An hour and a half after the time indicated on the summons sent to the head of the fokontany, the surveyor announced to the groups present that the demarcation could not take place.
“The essential administrative documents are not yet ready at the Topography service, as the file must go back to the commission. Since the plan and the background file are not yet available, we cannot carry out the demarcation,” he explained, attempting to ease the tension.
This demarcation comes in a particularly tense climate. The legal status of the land is the subject of a dispute between three distinct groups. A family present on site opposed the demarcation to defend what they consider their heritage. “This land belongs to our family. Our parents lived there and our family home is located there,” protested a representative of the group. For their part, new buyers have mandated their lawyer to demand the execution of a “writ of execution” (grosse). The lawyer for another group of buyers argues, on the contrary, that no operation should take place as long as the judicial procedure is not definitively closed. Furthermore, the lady claiming family ownership asserts that she has filed an appeal in cassation, which keeps the file in abeyance.
In the absence of a compliant topographic file and faced with this judicial entanglement, the operation had to be suspended until further notice.
