ELECTIONS – Consultation to determine the rules of the game

Proposals regarding electoral rules will be presented on November 9 and 10 at the CCI Ivato. It remains to be seen whether this arbitration will lead to a framework accepted by all.

The proposals have now been recorded. Their presentation at the CCI Ivato will open the arbitration phase. However, between the expectations of stakeholders, constitutional constraints, and a tight schedule, one question remains: will the consultation allow for the building of rules that are accepted and understood by both the political class and the citizens?

This restitution follows the receipt of contributions, which closed on Thursday, November 5. The transition from consultation to decision is the real challenge. It is no longer about correcting marginal provisions of the Electoral Code, but about rethinking the very governance of elections, from voter registration to the proclamation of results. The Refoundation Program provides for a new Independent National Electoral Commission (CENI), a dedicated electoral jurisdiction, and a legislative overhaul.

The AVI party, through the MP for Fandriana, Dr. Zavamanitra Andriamiharivolamena, is calling for the strengthening of this independence, increased control mechanisms, and higher qualifications for its members. The internal report of the CENI also points to several operational weaknesses: heavy budgetary dependence, a predominantly administrative staff, the lack of sanctioning or annulment powers, and insufficient communication regarding allegations of irregularities.

The debate also extends to the electoral litigation process. The High Constitutional Court (HCC) currently rules on referendums and presidential, legislative, and senatorial elections, while administrative courts handle territorial polls. The Program proposes a special independent jurisdiction for litigation and the proclamation of results. However, since the powers of the HCC are anchored in the Constitution, any change requires a constitutional revision, which is only envisioned between May and July 2027.

Ultimately, three indicators will measure the scope of this consultation: transparency regarding rejected proposals, the granting of real sanctioning powers to the CENI, and the clarification of the reform timeline before the first ballots are cast. Beyond the calendar and technical mechanisms, the credibility of the elections will rely on the trust placed in the process.
