A temporary provision under strict control. A decree adopted in March 2025 allows public administration services to use vehicles seized during judicial proceedings, but only under the strict supervision of the Agency for the Recovery of Illicit Assets (ARAI) and in compliance with regulatory conditions. Rado Rajohnson, Director General of ARAI, presented the implementation procedures for this decree during a training session organized by the Association of Women Journalists last week.
The decree authorizes ARAI, which manages seized assets, to make vehicles available to state services, decentralized territorial communities, anti-corruption bodies, and oversight institutions. The Director General emphasized that this measure aims to prevent vehicles immobilized for several years from deteriorating and losing value before a final judicial decision is rendered.
However, this provision is not automatic. Requesting organizations must demonstrate their capacity to ensure the maintenance and proper management of the vehicles. These vehicles must be registered with red license plates and remain subject to periodic checks by ARAI to verify their condition and usage.
According to Rado Rajohnson, “the vehicle is immediately withdrawn in case of abuse.” He specified that “sanctions do not only concern the offending user, but the entire beneficiary institution may lose the right to use all vehicles placed at its disposal.” He added that “the decree also provides that the personal liability of the perpetrator can be engaged.”
According to the Director General of ARAI, the vehicle is returned to its owner if a final court decision orders its restitution. He noted that several countries already apply this mechanism to preserve the value of seized assets pending the outcome of judicial proceedings. Created in 2022, the Agency for the Recovery of Illicit Assets currently manages 192 seized vehicles. Other vehicles seized by ARAI have been sold at public auctions, a procedure that also falls under the framework of preserving seized assets.
