Non-compliant labels. Enhanced labeling controls conducted by the National Authority for Corrective Measures (ANMCC) have revealed that some importers are using inappropriate Harmonized System (HS) codes for condensed milk and creamers. The ANMCC denounced these fraudulent practices during an information meeting held on Thursday, noting that they are used to evade the additional duties required for these products.
During the meeting with operators, the ANMCC reiterated that the annual quota for condensed milk and creamers exempt from additional duties is 3,000 tons. The agency, tasked with overseeing the application of trade defense measures in accordance with World Trade Organization (WTO) agreements, specified that beyond this quota, imports are subject to an additional duty of 29% until December 31, 2026, and 28% until June 5, 2027.
“Regardless of labeling requirements, condensed milk and creamers remain directly competing products falling within the scope of the safeguard measure,” insisted Barthélémy, Director General of the ANMCC. The definitive safeguard measure on condensed milk was implemented in September 2023, following ANMCC investigations that concluded there was an “increase in condensed milk imports” and “serious injury suffered by the domestic production sector.”
Until December 2023, out-of-quota imported products were subject to an additional duty of 32%. This duty has been gradually reduced and is expected to no longer apply from June 2027.
