Prosecution of Former Leaders – The HCC Gives the Green Light

The High Constitutional Court (HCC) approved yesterday the request from the Anti-Corruption Pole (PAC) to recognize its jurisdiction to judge cases involving former leaders, particularly for acts of abuse of power related to corruption.

This decision by the Ambohidahy judges follows a referral from the Directorate of Legislation and Litigation (DLC) at the Prime Minister’s Office, concerning three cases involving former President of the Republic Andry Rajoelina, former Prime Minister Christian Ntsay, former Minister of National Education Marie Michelle Sahondrarimalala, former Minister of Economy and Finance Rindra Hasimbelo Rabarinirinarison, former Minister of Mines and Strategic Resources Fidiniavo Ravokatra, and former Minister of Justice Herilaza Imbiky.

Regarding former President Andry Rajoelina, the proceedings before the PAC focus on the use of the sovereign fund managed by the State. Former Minister of Economy and Finance Rindra Hasimbelo Rabarinirinarison is also cited in this case.

Former Prime Minister Christian Ntsay, former Minister Fidiniavo Ravokatra, and former Minister of Justice Herilaza Imbiky are involved in suspicions of embezzlement of 36 kg of gold in 2019 and 2020.

Another case under the PAC’s jurisdiction concerns the awarding of a public contract for the purchase of chairs for public schools. Former Minister of National Education Marie Michelle Sahondrarimalala is implicated in this file.

In its decision published yesterday, the HCC specified, however, that the High Court of Justice (HCJ) remains competent to judge cases related to political responsibility and criminal offenses attributed to the concerned former leaders.
