The issue of whistleblower protection is back on the agenda. According to the Minister of Justice, Fanirisoa Ernaivo, the relevant draft bill is currently being reviewed by the government.
The progress of the draft bill was a key topic during a three-day regional workshop held at the Ibis Hotel in Ankorondrano, bringing together representatives from Indian Ocean islands. The Minister of Justice explained that the text is undergoing a rotating review by relevant ministerial departments for potential remarks or modifications. Once finalized, it will be adopted by the Government Council and then presented to the Council of Ministers before heading to Parliament.
Participants at the workshop emphasized that protecting whistleblowers and witnesses is a pillar of effective anti-corruption efforts. It encourages reporting and strengthens public trust in institutions. The process, which began several years ago, had previously faced deadlocks regarding professional secrecy and the definition of a whistleblower. However, recent efforts involving the UN Office on Drugs and Crime (UNODC) and the Anti-Corruption System (SAC) have led to a consensus on key definitions, including the requirement of acting in good faith and in the public interest.
While this progress is notable, other legislative gaps remain in Madagascar, such as the law on access to public information, which has been indefinitely postponed by the National Assembly since May.
