CONSTITUTIONALITY – The HCC validates the amended finance law

The High Constitutional Court (HCC) has declared the 2026 amended finance law to be in full compliance with the Constitution, without any reservations. The Head of State can now proceed with the promulgation of the text, which will govern the public budget for the remainder of the year.

The Court of Ambohidahy confirmed that the law meets all constitutional requirements, including the rationale for its development, the adoption process in the National Assembly, and the principle of budgetary balance. The HCC noted that the total revenue matches the estimated expenditure of 30,731,751,721 thousand ariary.

The law aims to achieve a 3.8% economic growth rate, a target the HCC describes as a realistic and prudent approach to the current economic climate. However, uncertainties remain regarding specific amendments, particularly concerning the budgets for the Ministry of Water and the Ministry of Energy, as well as the controversial Motor Vehicle Tax (TVM), which was expected to be suspended following public outcry.

Furthermore, the Group of Free Zone Enterprises and Partners (GEFP) has expressed strong concerns regarding the fiscal instability caused by new tax measures introduced between 2023 and 2026. Despite these concerns, National Assembly President Siteny Randrianasoloniaiko emphasized that the budget aligns with the state’s commitments to the International Monetary Fund (IMF) under the Extended Credit Facility (ECF) and the Resilience and Sustainability Facility (RSF).
