The new status of magistrates, adopted on July 8, 2026, was at the heart of the annual general assembly of the Syndicate of Magistrates of Madagascar (SMM), held on Friday at the Supreme Court in Anosy. Magistrates specifically reviewed the provisions already applicable and those still requiring implementing texts.
Some provisions of the new status can be implemented directly without the need for decrees or implementing laws. Others, however, require the adoption of regulatory texts. This distinction was the subject of discussions during the general assembly to determine the conditions for implementing the various provisions in the exercise of magistrates’ duties.
Furthermore, the Council of State was consulted for an opinion on certain provisions of the new status. Its opinion was delivered on Saturday, but the SMM did not yet have it at the time of the general assembly. The document will need to be examined before the syndicate makes a statement on the concerned provisions.
The situation of the jurisdictions was also addressed during the meeting. This issue follows the meeting organized this week by the Ministry of Justice with the presidents of the courts and tribunals of Madagascar. Workshops are also planned in the near future.
The general assembly thus allowed the SMM to take stock of the implementation status of the new statute and the provisions whose enforcement remains conditional on supplementary texts.
