The Magistrates’ Union of Madagascar (SMM) has taken a stand following the suspension of three judges from the Anti-Corruption Pole (PAC) last week, a decision made by the Ministry of Justice.
The union deems the procedure followed to be illegal. ‘This is harassment against our colleagues,’ declared Mbintanarivo Andriantsihorisoa, president of the SMM, yesterday. He emphasized that the action did not comply with the rules governing judicial procedures, noting that a review and analysis of the grounds for the decision should have occurred prior to the suspension.
The SMM is calling for the suspension of this ministerial measure. The Ministry of Justice justified the decision by citing ‘inadequate document management and failure to fulfill duties and responsibilities’ regarding corruption cases. The Ministry further stated that it would strictly enforce regulations governing court work, asserting that no discrimination would be made in taking measures against judges deemed incapable of performing their duties. This situation has led to heightened tensions between the SMM and the Ministry of Justice.
