A call to order. The Malagasy Copyright Office (Omda) is demanding the removal of radio plays broadcast without authorization on social networks and digital platforms, as well as the deletion of digital copies of this content stored on various media. The appeal mainly concerns works reproduced and uploaded online without the prior consent of their authors or rights holders.
In a statement, Omda indicated that it has observed an increase in cases of recording and broadcasting these radio programs without the prior authorization of the creators or the radio stations concerned. The organization reminds the public that intellectual works are protected by Malagasy copyright legislation from the moment of their creation.
Emphasizing the need for prior written authorization from the author or the rights holder for any sound recording, reproduction, or communication of a work to the public, the Office considers that “the use, sharing, or dissemination of content without authorization constitutes a violation of copyright provisions.” Any infringement can be “assimilated to counterfeiting, which may lead to legal sanctions,” it continues.
